The Geneva International Centre for Humanitarian Demining (GICHD) provides the Information Management System for Mine Action (IMSMA®) free of charge to the Mine Action Community. The GICHD is the sole holder of the copyright of IMSMA except for the following components. IMSMA includes elements developed with ArcGIS Engine under license from Environmental Systems Research Institute, Inc. (ESRI) 380 New York Street Redlands, CA 92373-8100 . ESRI and the ESRI Logo are licensed trademarks of Environmental Systems Research Institute, Inc. Swiss GIS data is provided and copyrighted by the Swiss National Cartography Agency, L+T, Bern, Switzerland.
The user of IMSMA and its components is solely responsible for obtaining and maintaining all external support elements required for its operation. The GICHD takes no responsibility for the provision of any support hardware, software or computer operating system required to operate IMSMA under this license agreement.
Any use or installation of IMSMA or any of its components constitutes agreement with the following terms and conditions.
- The IMSMA system and components licensed under this agreement remain the property of the GICHD.
- This license may not be used in connection with any commercial enterprise without the express prior written permission of the GICHD.
- This IMSMA user license is granted for the purpose of providing information management support to legally constituted and recognized mine action organizations and their activities. Each proposed use of the system by a licensee must be authorized in advance by the GICHD.
- This license grants the right to use IMSMA within a specific context and or in support of operations within a specifically defined physical area. The Geneva Centre retains the sole right to determine the legitimacy of the use of the system.
- This license grants the right to create a single back-up copy of the software for purposes of recovery. The software may not be otherwise copied or reproduced in any form without the prior written consent of the GICHD.
- This license grants the right to use IMSMA as delivered by the GICHD making modification of the system only as provided by the customization options provided in the software.
- This license may not be transferred or sublicensed to any government, organization, group or individual without the prior written consent of the GICHD.
- The IMSMA software and its components may not be changed, copied or distributed in any way without the express prior written consent of the GICHD. Any attempt to change, copy, reverse engineer or distribute IMSMA without prior written consent is prohibited and will automatically terminate this license.
- All information collected and stored in the system is the sole property of the accepted legal authority for the area to which it applies regardless of the location of the data collection or data entry in to the system.
- The user agrees to make all data collected and stored in IMSMA available to the appropriate local, national, regional or international authorities upon request. Such data turnover shall be subject to the establishment of appropriate safeguards for the handling of sensitive personal information and the establishment of appropriate transfer agreements.
- The user agrees to make every effort to ensure that all information contained in the IMSMA database remains unclassified at all times and open to public dissemination, as appropriate, to allow timely and efficient utilization of the information for humanitarian purposes.
- In the event the operation of IMSMA granted by this license is terminated for any reason the user agrees to notify the GICHD of such termination within 60 days.
- Upon termination of IMSMA operations under this license the user agrees to transfer all data collected to the appropriate national, local, international or other recognized mine action authority for the area and to return to the GICHD all materials distributed with IMSMA including but not limited to license keys, system distribution disks, user manuals and training materials.
- The parties agree to waive any claims against each other or against the developers of the software as related to injury of personnel or damage to goods and equipment resulting from the use of IMSMA or information provided from IMSMA. This includes, but is not limited to, any third party claims. Either party may terminate this agreement with 30 days written notice.
NO WARRANTY
THERE IS NO WARRANTY FOR THE SOFTWARE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDER PROVIDES THE SOFTWARE "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH THE USER. SHOULD THE SOFTWARE PROVE DEFECTIVE, THE USER ASSUMES THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL THE COPYRIGHT HOLDER, OR ANY OTHER PARTY LEGALLY AUTHORIZED TO CREATE, MODIFY AND/OR REDISTRIBUTE THE PROGRAM BE LIABLE FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY THE USER OR THIRD PARTIES OR A FAILURE OF THE SOFTWARE TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
